# WhyxLicense — End-User License Agreement > **By downloading, accessing, or using this model in any form, you fully agree to the terms set forth in this document. It is a binding agreement between the end user and the rights holder. Attribution ### 1.1 Mandatory Credit When sharing or publishing any content created with this model — including images (only when used for commercial purposes), videos (also if the purpose is commercial), social media posts, portfolios, promotional materials, or any other activities — you must explicitly credit the rights holder: **ArtShumov / [Model Name]** Provided this attribution is clearly visible, publishing such content is permitted without additional restrictions. Attribution is equally required for any commercial use of the model's outputs. Failure to credit the author constitutes a violation of this license regardless of the context or platform. --- ## 2. Platform Rules Online generation using this model is permitted **only** on the platforms explicitly listed below. Each platform has a clearly defined scope of permitted activity. The scope of permitted and prohibited activity is defined strictly as follows: **Permitted on CivitAI:** - Publishing images generated with this model - Publishing videos generated with this model **Prohibited on CivitAI** — everything else, including but not limited to: - Uploading, hosting, or distributing this model or any derivative of it - Re-posting, mirroring, or archiving the model files - Using the model as a training base via CivitAI's tools For the full list of distribution and modification prohibitions, see Section 4. ### 2.3 Prohibited Platforms — Full Restriction On all platforms marked as **Prohibited** — including PixAI, Yodayo/Moescape, and any platform not explicitly listed in this license — **no activity involving this model or its outputs is permitted.** This includes, without limitation: - Any generation, whether for personal or shared use - Posting or sharing images, videos, or any content produced with this model - Uploading, hosting, or distributing the model or its derivatives - Any commercial or non-commercial activity This restriction is absolute. If an activity involves this model on a prohibited platform in any capacity, it is forbidden. --- ## 3. Local / Offline Use Downloading the model for local, offline generation is permitted **only** for models explicitly marked as available for download. Any model not listed above is **not available for download** unless explicitly stated otherwise. Downloading unlisted models without authorization constitutes a violation of this license. --- ## 4. Distribution and Modification The following actions are strictly forbidden regardless of platform or context: - Redistributing this model or its weights in any form, paid or free - Selling, licensing, or otherwise transferring the model to third parties - Merging this model or LoRA with other checkpoints or model architectures - Splitting, remixing, or altering model weights - Modifying merge permissions or repackaging the model under a different license - Using this model as a base for further training — including fine-tuning, transfer learning, and RLHF — on any platform --- ## 5. Commercial Use ### 5.1 General Prohibition Any use of this model or its outputs that results in **direct or indirect financial gain** is considered commercial use and is **prohibited** without explicit written permission from the rights holder. ### 5.2 Examples of Prohibited Commercial Activity - Selling images, prints, NFTs, or other artifacts produced with this model - Using generated content in paid products: merchandise, printed goods, paid courses, books, etc. - Integrating the model or its outputs into paid APIs, SaaS applications, subscription services, or bots - Publishing content on monetized platforms (e.g., YouTube with ad revenue, Patreon, subscription feeds) where revenue is directly tied to content produced by this model - Any other arrangement where this model contributes to generating revenue ### 5.3 Requesting a Commercial License To obtain a commercial license, contact the rights holder with a detailed written description of the intended use. Violations and Enforcement ### 6.1 Zero Tolerance Policy Violations of this license — including unauthorized use, distribution, plagiarism, or failure to attribute — will be addressed immediately and without exception. ### 6.2 Consequences of Violation Upon confirmed violation, the rights holder reserves the right to: - Issue a **permanent ban** from all of the rights holder's resources and platforms - File **formal complaints** with any platform where the violation occurred, requesting removal of infringing content and restriction of the offending account - Pursue further action as appropriate under applicable law or platform policy ### 6.3 Reporting Violations **Email:** artshumov@gmail.com / evildevolver@zohomail.eu **Discord:** @artshumov > The time, resources, energy, and creativity invested in developing this model deserve respect. Access is granted at the rights holder's discretion and may be revoked at any time. ### 7.2 SeaArt.ai Exclusive Status Certain models carry **EXCLUSIVE** status on SeaArt.ai. General Terms - This license is **non-negotiable** and applies automatically to all users upon access or use of the model. - This license applies equally to all derivatives and outputs of the model. - The rights holder reserves the right to update or amend this license at any time. The version and date of the most recent update are listed at the top of this document. - Continued use of the model after a license update constitutes acceptance of the revised terms. --- ## 9.
